CORSICA ACTIVITIES

CORSICA ACTIVITIES is an activity booking platform. Signing up for an activity implies pure and simple acceptance of these terms and conditions by the subscriber, who commits to informing each participant of all modalities.

Art. 1: SCOPE
CORSICA ACTIVITIES organizes, commercializes canyoning activities in Corsica.
Collective activities: defined as collective activities, activities proposed to individuals or groups of individuals who register separately and are grouped in the same outing. This may be, for example, single people, groups of friends or families.
Private activities: defined as activities proposed to institutions, companies, associations, etc...

Art. 2: PRACTICE PARTICULARITY
Outdoor activities proposed by Corsica Activities are subject to climatic and human contingencies. Changes in canyon conditions are not always predictable, this implies the possibility of program change at any time.
Ultimately, the instructor remains sole judge of the program which he can adapt for safety reasons.

Art. 3: REGISTRATION AND RESERVATION
Any registration for our activities implies adherence to our general conditions of sale.
Reservation by phone: a deposit is paid at reservation; the balance is due on the day of activity, a bank imprint will be requested as a guarantee.
Online reservation: payment is requested in full at reservation; file fees are applied.
Collective activities: registration is effective from the moment the subscriber receives a confirmation email for the selected outing.
Private activities: registration is effective upon receipt of the deposit corresponding to 30% of the total service amount and a booking confirmation email for the selected outing.

Art. 4: MINIMUM NUMBER OF PARTICIPANTS
Our outings are assured if the minimum number of participants is registered, in case of too few registered, the outing is postponed or canceled - See our cancellation conditions.

Art. 5: PRICE
CORSICA ACTIVITIES rates are presented on the website www.canyon-corse.com
Prices are clearly displayed net or including taxes and present VAT amounts at 10%, 20% and special rates.
Discounts: The websites managed by CORSICA ACTIVITIES offer occasional promotional offers. These apply to reservations made only under the reference of these offers and on the announced periods.

Prices include: organization, the service of supervision ensured by a state-certified guide and the loan of technical and safety equipment necessary to practice the chosen activity.
In all cases, we invite you to refer to the technical sheet of the product, available on our website or on simple request.
Prices do not include: possible rental of equipment (ex: Go Pro, mobile), transport to the place of activity (place of meeting and practice site) and charges of a personal nature.
Meals (picnic, water, snack) are the responsibility of the customer, unless otherwise stated.

Art. 6: PARTICULAR REGISTRATION CONDITIONS
Engagement and solidarity: As part of a group, or registration for multiple people, the subscriber undertakes to make known and approve the general conditions as well as activity documentation to all registered participants.
In case of breach of CGV (delay, cancellation, abandonment), of one or more participants, the full amount of services is due by the subscriber.

Art 7: PAYMENT METHOD
For supervision services, payment must be sent (made out) directly to CORSICA ACTIVITIES. This mention will be stated at the time of reservation.
Accepted payment methods: check, vacation vouchers (up to €100), bank transfer, credit card (secure payment via internet) or cash.

Art. 8: WITHDRAWALS
The right to withdraw the consumer according to articles L221-28-12 of the Consumer Code are not applicable to contracts having as their object the provision of services of accommodation, transport, food, leisure, dated activities. The contractor will therefore have no right of withdrawal.


Art. 9: PARTICIPATION CONDITIONS
Our activities are open to all; nevertheless depending on the activities and the routes, certain conditions must be taken into account (age limit, swimming ability, technical level, physical condition, etc...).
CORSICA ACTIVITIES does not have the means to verify the sporting practice level of its customers.
It is therefore up to each participant to evaluate his physical form according to the course choices he wishes to make. To know these conditions, please refer to the technical sheets of the routes (viewable on our website www.canyon-corse.com).
For whitewater and water activities, it is imperative to know how to swim and submerge.
KNOW: the use of sunscreen is formally prohibited in canyons. Any breach of this rule by a participant will result in his exclusion from the canyoning group.
You must not be subject to medical contraindication to practicing the chosen activity.
IMPORTANT: You are not subject to medical contraindication but you are dependent on care or special medical treatments (asthma, diabetes, etc.) or your state of health requires special attention (fragile joint, back problem, compulsory wearing of glasses, etc.), you must imperatively inform the reservation service which, in relation with the instructor, will validate or not your reservation.
You must also and imperatively inform the Instructor before the start of the activity and plan emergency medications, according to medical recommendations.

Art. 10: INSURANCE
In accordance with legislation, CORSICA ACTIVITIES is equipped with professional liability insurance.
Each participant must also be holder of individual liability insurance. In order to protect yourself in case of incident or accident that may occur during the activity, it is essential for you to have multi-risk coverage covering cancellation fees, assistance and repatriation.
We cannot substitute for individual liability insurance for each participant.
The supervisors are independent and have their own Professional Liability Insurance.
In case of bodily injury, CORSICA ACTIVITIES and the supervising instructor's responsibility is discharged from the moment the victim is taken care of by the competent rescue organizations, and any hospital follow-up will be the responsibility of the accidental's personal insurance.
The practice of outdoor activities takes place in an environment specifically called "at risk".
Each participant is aware, given the specific nature of the activities proposed, that it can run certain risks due in particular to distance, isolation and the specific nature of the environment (river, cave, cliff, etc...). They assume them with full knowledge and must comply with prudence rules and follow advice given by professionals.
The participant/customer is responsible for the equipment loaned to him for the activity. The professional cannot be held responsible for damage that may be caused by the loaned equipment.
In case of theft or deterioration of loaned equipment, the participant/customer may be asked to make compensation related to wear or a full refund of the equipment.
Professionals (instructors) and CORSICA ACTIVITIES cannot be held responsible for loss, theft (including in vehicles) or breakage of objects (ex: glasses, cameras…) that practitioners could take with them during the activity and that may occur during the activity.

Art. 11: CANCELLATIONS / MODIFICATIONS
- Cancellation on your part:
Any cancellation on your part must reach us no later than 48 hours before the start of the activity.
The amount of sums retained is calculated according to the following schedule:
* More than 48 hours before the start of activity: full refund of sums paid at registration
* From 48 hours to 24 hours before departure: 75% of the activity price is due
* Less than 24 hours before departure: the full price of the activity is due
Non-attendance at the meeting: in case of non-attendance at the activity, no refund will be made.
Delay: any delay on your part to the place and time of the activity meeting is considered cancellation less than 24 hours and therefore gives no right to refund.
Abandonment: Any voluntary interruption of your activity does not entitle to any refund, as well as an exclusion decided by your supervisor, for insufficient level or non-respect of safety instructions.

In case of inability to carry out the activity on your part, you can propose to us another person provided that they meet the same conditions.

- Our cancellation
If we had to cancel a departure of activities for reasons beyond our control, bad weather (...) we would propose if possible different replacement solutions, at the current rate, or full refund of the sums received.
In case of interruption of the activity on our part for safety reasons, the refunded sums are fixed according to the following schedule:
Ongoing or completed approach walk: full refund of the activity price
Canyon descent ongoing: 50% refund of the activity price
Exclusion: at any time our supervisors can decide the exclusion of one or more participants from an activity for insufficient level, non-compliance with safety instructions or any other reason deemed important by the instructor.

Art. 12: MEETING POINT
An hour and a place to meet are systematically communicated to you whatever the service. For the smooth running of activities and out of respect for other participants and the professional supervising you, please take note of the information previously transmitted by us. Plan to anticipate your routes to be on time. We tolerate a maximum delay of 10 minutes. Beyond this period, the instructors leave in activities and no refund or compensation will be due.


Art. 13: SUPERVISION OF YOUTH (MINORS)
Unaccompanied minors:
Minors under 14 not accompanied by an adult (legal guardian) are not accepted in so-called "collective" activities.
Minors aged 14 to 18 not accompanied may be accepted in "collective" activities, subject to parental authorization and under certain conditions (sporting level, skill, etc...)
In this case, parental authorization will be signed by the legal representative on the day of activity.
In the event that the activity requires movement on site (cliff, canyon, cave, etc...), the minor's transport must be ensured by the legal representative.

Minors within CVL / CLSH / School framework:
The organization organizing the stay or outing must be able to provide the instructor and CORSICA ACTIVITIES, for each participant (young person and educator):
- an attestation of swimming of 25 meters and ability to submerge,
- the health record of each participant.

Furthermore, CORSICA ACTIVITIES undertakes to provide the necessary attestations and documents for the organization of the stay / outing (DDCSPP authorization, insurance, instructor diplomas, etc...)
Supervision of young minors is subject to regulations that limit it to 8 young people and 1 educator (maximum). Each group of minors must be accompanied by 2 adults including one educator from the center and the supervising instructor.

ART. 14: GIFT VOUCHER
The gift voucher is effective upon receipt of the full amount of the service.
The order form is personal. However, it can be transferred to the person of your choice provided you inform us in advance to modify the details of the new beneficiary.
The gift voucher beneficiary must imperatively contact us to book the outing.
The activity of the gift voucher is replaceable by another activity proposed by CORSICA ACTIVITIES, provided that the value of this one is less than or equal to the activity mentioned on the gift voucher. However, it is possible to perform an activity of a higher amount by paying the difference.
CAUTION: The gift voucher has an expiration date. Beyond the validity period (current year), the service will be considered executed and cannot be postponed. The beneficiary and / or buyer cannot claim any refund or compensation.
The gift voucher and the personal document must be presented on the day of the outing to the instructor in charge of the session.
The outing will be guaranteed in the event that the minimum number of required participants is ensured and in the event that the weather conditions allow the good practice of the activity.


Art. 15: USE OF PERSONAL DATA
CORSICA ACTIVITIES as well as its online booking service provider and planning management SARL L'AGENZA / RESACTIVITE undertake to protect the personal data of their customers: none of the two entities resell, share or monetize customer data.
CORSICA ACTIVITIES and L'AGENZA ensure that they do not collect data allowing identification of natural persons other than those explicitly requested from the reservation subscriber.
CORSICA ACTIVITIES and L'AGENZA retain the data provided by their customers for 6 years for fiscal reasons, in particular in compliance with the 2018 Finance Law and the fight against VAT fraud.
Even on explicit request from the customer, CORSICA ACTIVITIES cannot delete any data from the RESACTIVITE software, as it is used to achieve pricing within the framework of the 2018 Finance Law.


Art. 16: DISPUTES
Any complaint relating to the trip must be addressed to CORSICA ACTIVITIES by registered mail with acknowledgment of receipt within one month after the date of return and will be the responsibility of Ajaccio Commercial Court.
